Landmark Cases

When I first heard the words criminal justice. I thought about criminals to be honest. Since I've studying it in school it has really enlighten my knowledge. Clarence Gideon is my favorite case of all time. His case change the legal system for everyone. Thanks Clarence Gideon every one has the right to an attorney.  If he hadn't set down with a pencil and wrote to the U.S. supreme court.  I believe a lot of innocence people would have been in jail today. That is why Gideon case is truly a landmark case. Another case that change history Miranda vs. Arizona. Here a paper show the details about the case.  I wrote this paper for Introduction to criminal Justice. It explain the Miranda vs. Arizona trial.

Miranda vs. Arizona is a landmark case that establishes the area of the rights of criminal suspects and led to the requirement that police give "Miranda rights" to a suspect before taking a statement.   (You have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to speak to an attorney, and to have an attorney present during any questioning. If you cannot afford a lawyer, one will be provided for you at government expense.) It was later revised to you have the right to remain silent and refuse to answer questions. Do you understand? Anything you do say may be used against you in a court of law. Do you understand? You have the right to consult an attorney before speaking to the police and to have an attorney present during questioning now or in the future. Do you understand? If you cannot afford an attorney, one will be appointed for you before any questioning if you wish. Do you understand? If you decide to answer questions now without an attorney present you will still have the right to stop answering at any time until you talk to an attorney. Do you understand? Knowing and understanding your rights as I have explained them to you, are you willing to answer my questions without an attorney present? (Mount, 2008) These rights are required to read to before questioning. If your question without being read you Miranda rights. Then it will not admissible in court of law. This was establish a very popular case Miranda v. Arizona.

Ernesto Miranda was arrested and interrogated for kidnapped and rape without being told of his rights.  He also gave a full confession without being told he has the rights. Which validates his civil rights such as 4^th and 14^th amendments? Although the police argue in court that since he had previously in trouble that he should know his rights.
